Preamble

EVIDENTIELLE SARL is a company based in Switzerland that designs and manufactures cosmetic products based on natural products.

The Customer adheres to the Conditions of Sale and Conditions of Delivery of the Products as well as to the Legal Notices and Conditions of Use of the site www.evidentielle.ch governing the contractual relations between himself (natural person or legal entity) and EVIDENTIELLE SARL , in particular on the occasion of the purchase of a Product by the Customer on the site www.evidentielle.ch.

The Client of the site www.evidentielle.ch declares to be domiciled in Switzerland, to be capable of contracting under the law and, where applicable, to validly represent the person for whom he is making a commitment.

The Client of the site www.evidentielle.ch declares that they have the skills and means necessary to subscribe to, access the services offered by EVIDENTIELLE SARL and use them.

Intellectual property / copyright

The entire site www.evidentielle.ch , the texts, photos, videos, sounds, descriptions, quality charter, products, logo, brand, formulas, absolutely all content is the entire property of EVIDENTIELLE SARL . Any total or partial copy is prohibited. The EVIDENTIELLE SARL brand cannot be used without prior written agreement with the brand.

Product Description

EVIDENTIELLE SARL offers the online purchase of Products on the website www.evidentielle.ch .

The photos of the Products on the site www.evidentielle.ch are not contractual.

The Products are more fully described in the pages of the website www.evidentielle.ch

The prices are specified on the website www.evidentielle.ch for each of the Products, as well as the delivery costs relating to their shipment to the address chosen by the Customer.

Order validation

After having read the description of the different Products offered, their prices, the Conditions of Use, the Legal Notices, the Conditions of Sale and the Conditions of Delivery, the Customer selects the Product(s) he wishes to order as well as the method of delivery of the Products.

By placing an order, the Customer acknowledges having read the specific conditions of sale contained in the pages of the website www.evidentielle.ch (weight, quantity, specific usage) and expressly declares that they accept them without reservation.

When validating the order, the Customer will have the option:

• to change his choices,
• to reread the General Conditions of Use and the General Conditions of Sale,
• to proceed with the Acceptance of his order by clicking on the button “Validate your order”.

Acceptance implies total and unconditional acceptance by the Customer of these Conditions of Sale as well as the General Conditions of Use and Conditions of Delivery of the site www.evidentielle.ch subject to any derogating provisions established in writing between EVIDENTIELLE SARL and the Customer.

Unless proven otherwise, the data provided by the Client and recorded by EVIDENTIELLE SARL constitute proof of the elements of the contract and the terms and conditions which govern the relationship between EVIDENTIELLE SARL and the Client.

After Acceptance, the Customer will receive an email confirming their order at the email address they provided. This email will confirm receipt of the Customer's order by EVIDENTIELLE SARL .

In the event of an abnormally large order from a Customer, EVIDENTIELLE SARL reserves the right to cancel this order and contact the Customer to inform them.

EVIDENTIELLE SARL reserves the right to validate the Client's identity before delivering the Product to the Client.

Validity of the information provided

The Client of the site www.evidentielle.ch undertakes to provide real, exact, up-to-date information at the time of entering it in the service registration form.

Otherwise, EVIDENTIELLE SARL declines all responsibility in the absence of delivery, total or partial, of the Products ordered by the Customer.

Price

EVIDENTIELLE SARL reserves the right to modify the prices of its Products at any time according to the procedure described in the "modifications of the General Conditions of Sale". In any event, the Products will be invoiced on the basis of the price of the Products displayed at the time of Acceptance.

Payment

Payment for the Products ordered is made by:

• Bank card (Visa or Mastercard)
• Post-finance
• TWINT

The online payment service is secure but does not include any additional insurance policy, particularly in the event of theft of the customer's bank card.

In the event of non-payment due to fraudulent use of a means of payment, EVIDENTIELLE SARL reserves the right to apply additional administration fees to the Customer.

It is the Customer's responsibility to check the payment submission form before any Acceptance.

In any event, EVIDENTIELLE SARL cannot be held responsible for problems or delays linked to the operation of payment procedures.

The amounts paid as part of an online payment may not under any circumstances be considered as deposits or down payments.

Modification of the General Conditions of Sale

EVIDENTIELLE SARL reserves the right to modify and supplement these General Conditions of Sale as well as the scope of its services to the Customer of the site www.evidentielle.ch.

These modifications will come into force when they are posted online on the website www.evidentielle.ch , it being understood that the price of the Product will in any event be that displayed at the time of Acceptance.

Delivery services

Subject to specific stipulation, and from the day the order is prepared, the Products ordered will be delivered to the Delivery Territory (Switzerland).

Shipping costs are not included in the prices of the Products as displayed on the pages of the site www.evidentielle.ch describing the Products. However, at the time of validation of the order, the price will include the costs relating to the delivery of the Products.

Delivery and shipping costs

The Customer pays delivery costs of CHF 7.- for any order less than CHF 100.-. For any order over CHF 100.-, delivery costs are free.

Delivery times are expressed as follows: order processing, 2 to 4 working days (Saturdays and public holidays are not considered working days). Once the order has been processed, Swiss Post will send the package.

EVIDENTIELLE SARL collaborates with Swiss Post for the delivery of products, according to the formula chosen by the customer for shipping, it is impossible to manage special requests concerning delivery changes, packages to be delivered at specific times and other specific requests.

Absence of any liability relating to delivery, in particular in the following cases:

– Return of package due to an incorrect or incomplete address. The package may be reshipped against payment of new shipping costs.
– Return of package following non-collection of the package within the time limits from the delivery service provider. A new package may be sent at the customer's request, subject to new invoicing at the customer's expense.

EVIDENTIELLE SARL declines all responsibility from the moment the package is delivered by the Post Office.

Complaints

If the Products delivered do not conform in nature or quality to the specifications indicated according to the order, complaints must be sent to info@evidentielle.ch within 48 hours of receipt of the Products. After this period, no complaints will be taken into account.

The return of the goods must be preceded by the acceptance of a return request submitted by the Customer to info@evidentielle.ch .

Returns must be made to the following address: EVIDENTIELLE SARL, Chemin des Acacias 5, 2114 Fleurier. Non-compliant merchandise must be returned in its original, unopened packaging.

Data protection

EVIDENTIELLE SARL undertakes to process your personal data relevant to each order in accordance with the corresponding legal provisions on data protection for the purposes of contract execution.
